In most situations, YES! Most every type of Unlawful Detainer begins with some sort of Eviction Notice. $99 is the charge for the proper Eviction Notice, placing your Eviction on the right path to successfully delivering you possession of your property. 


​In certain situations, clients may be able to save on this charge if they have delivered a properly formatted notice, sufficient to start a successful Unlawful Detainer action. In other situations, additional add on notices or notifications may be required  to meet legal compliance. See below for these additional notices and notifications along with  their respective fees.

We eFile through the Superior Court's eFiling System for all our cases. We have found that cases move a week to two weeks faster than paper filings. This fee will cover all your document submission fees though out your eviction case.

An order to post is only needed when the defendant makes it difficult to serve them.  The court will then permission to post the Unlawful Detainer on the property along with sending a copy via certified mail.

Eviction Notice has been properly served via personal, substitute service or posting along with mailing by landlord or property manager will be reviewed by our Licensed, Registered and Bonded Unlawful Detainer Assistant for errors.  If 3 Day Notice is error-free from all the pertinent criteria any Judge or opposing counsel can point out, then our office will immediately go forward with the preparation of the Court required Unlawful Detainer paperwork for filing.  For those clients who decide to go forward with a faulty 3 Day Notice, they will be required to sign a waiver stating they acknowledge the 3 Day contains errors and may result in an unfavorable outcome if contested.

When a rental property is located in the city of San Diego and the tenant/occupant has resided in the property for over 2 years, then the eviction notice is required to cite the ordinance with the appropriate "just cause".
